We represent Police Officers subject to Regulation 9 / Regulation 15 notices. We can advise the officers as to the best way to respond to the notices that protects their position.


If an Officer is subject to either a Misconduct Hearing with Legal Representation (under the Police (Conduct) Regulations 2004) or to a Gross Misconduct Hearing (under the Police (Conduct) Regulations 2008) we are experienced in preparing the Officer’s case in the best way to a Police Panel protecting the Officer’s position.

We have dealt with the Appeals processes, whether that is before a Chief Constable on Review or to the Police Appeals Tribunal.

We are familiar with the tactical implications of Judicial Review in relation to Police Discipline procedures.

We have a particular expertise in dealing with drink drive cases and Police Discipline procedures. Our Mandip Kumar dealt with the case of Elkin that is the leading authority in Police Disciplinary cases dealing with the draconian interpretation of Annex N (or its principles under the 2008 Regulations).

A selection of our experience in Police Discipline cases includes (but not limited to) the following:

  • 5 Officers subject to Police Misconduct charges of “General Conduct/Abuse of Position” relating to an allegation of assault on prisoner whilst in custody. Successful half-time submission.

  • 3 Officers (1 PS and 2 PC’s) subject to Police Misconduct charges of “General Conduct/Abuse of Position” relating to an allegation of assault during arrest. Charges proved but all kept their jobs and rank.

  • 7 Officers (5 PC’s and 2 retired) and 1 civilian member of staff subject to a criminal and misconduct charges of Conspiracy to Pervert the Course of Justice/Honesty & Integrity. Advice provided regarding challenge to PSD’s decision to instigate investigation and consideration of the Police Reform Act 2002 and The Police (Complaints and Misconduct) Regulations 2004.

  • PC: allegation of “abuse of position” and of a sexual nature. Acquitted/charge not proven.

  • PC: Instructed at appeal stage/Police Appeal Tribunal (PAT). Successful appeal and officer re-instated. Full costs granted by the PAT.

  • 5 Fire Arms Officers subject to allegations of excessive use of force. Allegation made by another police officer. No further action and case concluded at investigation stage.

  • PC: Successful Chief Constable’s Review, re criminal assault conviction, and officer re-instated.
